4-Day School Week Doesn’t Mean 3-Day Weekend For Teachers

posted on November 20, 2015 Several Oklahoma superintendents in districts south of the Oklahoma City metro area are considering switching to a 4-day school week, according to several news sources. Working parents in the comments on those articles have expressed concern that they’ll have to pay for  additional daycare options (including have to pay for a week of daycare when only using one day), bus drivers are concerned about a decrease in their wages, and teachers are concerned about those students who rely on the school for regular meals, and who must care for younger siblings. However, the 35 districts in Oklahoma who have already converted to the shorter school week have reported significant savings in utilities and other expenses related to the daily operation of their schools, according to News9.com. Superintendents are considering this option as a way to deal with foreseen budget shortfalls as a result of the growing shortage in state funds.   All of these considerations aside, I consider this switch a possible way to make teaching more bearable for classroom teachers with ever-increasing rosters. With 120 students, I spend hours each week grading papers. After a full day of school, I frequently return home to rest, try to spend time with my family, and grade papers that don’t require my undivided attention. I continue grading  papers and begin planing lessons on Saturday, which has been known to take the entire day. I spend Sunday at church, then in the #OklaEd chat, and then finalize those lesson plans. Having that extra day each week — whether it’s Monday or Friday — would allow me to return Saturday to my own children and husband (After all, I’m the ONLY mother and wife they have!) and enable me to relax more on Sunday. I could shift the bulk of my grading and lesson planning to the â€Å"day off† and be better prepared to teach the other four days of the week. Generally speaking, and with the information I have, I am for this move, in the event my school district considers it. The house leadership under Nancy Pelosi (D-CA) refused to allow the US senate of any party to even consider debating, let alone voting on Obama care. The house by passed the entire U.S. senate by using a controversial self-executing rule or â€Å"deem and pass† procedure then quickly sent it to president Obama to sign†(Net advisor). This brings out the question, what if the Democratic Party had not made such an irrational decision to pass the Obama Care, would it have made any difference in the case of the government shutdown. Since the main reason that led to most of the republican members to oppose raising the debt ceiling that would have prevented the government from shutting down was primarily a disagreement in the Obama care. This is arguable in both sides since the republican party might also have made a groupthink decision to prevent the Obama care under any circumstances, leading to a government shutdown that has dented the government debt even more, ironically an issue that they (republican party) are trying to avoid with the Obama care. Perhaps the buyer and seller had reached an oral agreement when another buyer made an offer on the property. Maybe one of the parties got cold feet and wanted to back out of the deal even after signing the contract. To determine whether parties have an enforceable contract, you must be familiar with two basic concepts of contract law: the Statute of Frauds and the concept of acceptance. The Statute of Frauds Every state has a law known as the Statute of Frauds, which requires certain contracts to be in writing in order to be enforceable. Included in the North Carolina Statute of Frauds are certain long-term leases and all contracts for the sale of land or any interest in land. The Concept of Acceptance The second important concept in determining whether you have an enforceable contract is that of acceptance. Along with offer and consideration, acceptance is required in every contract between two or more parties in order for the contract to be legally valid. Generally, it is easy to determine when you have an offer in a real estate transaction. In North Carolina, a buyer usually makes the initial offer in writing, (often on the standard Offer to Purchase and Contract form), signs the offer and presents it to the seller or the sellers agent. Likewise, consideration something of value given to induce the other party to enter the contract is usually not an issue in real estate contracts. Typically, the buyer promises to give money or property to induce a seller to convey real property. This does not mean that earnest money is required to form an enforceable contract; the parties can form an enforceable contract without the buyer giving earnest money provided the other requirements are met. ) The remaining issue in real estate contracts, then, is the question of whether acceptance has occurred. Only when a contract has been properly accepted does it become enforce able. Signature While a full signature is preferred, any mark will suffice including initials or even an Y (for instance, when one of the parties is unable to write) as long as it is made with the intent of the signer to be bound to the contract. There have even been cases in which a letterhead was considered a sufficient signature for a party. Similarly, the signature does not have to appear at the bottom of the document. Although it is preferable for the signature to be at the bottom, the contract will still be valid if the signature appears elsewhere. A party can therefore initial a contract at the side (as when rewriting a counteroffer) and be bound to the contract. 2. Communication of Acceptance Signature alone is not sufficient to constitute a valid acceptance: the accepting party must also communicate acceptance to the party who made the last offer or counteroffer. Assume, for example, that a buyer makes a written, signed offer which is delivered to the listing agent and then to the seller. The seller likes the offer exactly as written and signs it. Has a binding contract been created? No! The seller has not communicated acceptance back to the buyer. The contract will not be binding until the buyer (or the buyers agent) learns of the sellers acceptance. Unless the parties have agreed to a particular method of communication, communication of acceptance can be made in any manner that is convenient for the parties, and can even occur accidentally. Therefore, in a typical residential sales transaction, communication of acceptance can be made orally, e. . , by calling and advising the buyer of acceptance. This oral acceptance does not violate the Statute of Frauds because the contract itself has been written and signed. It is only the communication of acceptance that is oral. (Note that delivery of the contract document is not required to make a contract enforceable. The contract is formed at the time of communication. The real estate agent does, of course, have a duty to provide copies of the contract to the parties under the Real E state License Law. Because communication must be made to the other party in the transaction or to the other partys agent, it is important to know whether the real estate agents involved represent the buyer or the seller. a. Communicating acceptance of a buyers offer or counteroffer Suppose that a seller signs a buyers written offer and then tells the listing agent that he has accepted the offer. Is the sellers statement to the listing agent sufficient to create a binding contract? No. The seller has communicated acceptance only to his own agent, not to the buyer or to the buyers agent. So, the contract is not yet enforceable. Assume then that the listing agent tells the selling agent that the seller has signed and accepted the buyers offer. Has communication of acceptance been accomplished? The answer depends upon which party the selling agent represents. If the selling agent is a subagent of the seller, communication to the selling agent does not create a binding contract. However, if the selling agent is a buyers agent, communication to him is as good as communication to the buyer herself: the contract is enforceable once the buyer or the buyers agent learns that the seller has signed the buyers written, signed offer. b. Communicating acceptance of a sellers counteroffer Now suppose that the seller rejects the buyers offer but makes a written, signed counteroffer. To accept the sellers counteroffer, the buyer must do two things: (1) sign the counteroffer, and (2) communicate acceptance back to the seller or to the sellers agent. A signature, without communication, does not create a contract. Conversely, communication of acceptance, without a signature, does not create a contract. Remember that communication of the buyers acceptance must be made to the seller or to the sellers agent or subagent. If a buyer communicates acceptance to his own agent, i. e. , a buyers agent, no binding contract has been created. c. Oral negotiations Often after the buyer makes an initial written offer, all subsequent negotiations are communicated orally through the real estate agents involved in the transaction. The problem was that, as it has been revealed to Amir by Rahim Khan, Hassan ended up being killed by a ravaging mob of Taliban guerillas. Yet, Hassan’s son Sohrab was able to survive an ordeal. The context of this particular scene suggests that the consequence of Amir proving himself courageous enough to act loyally towards Hassan’s son, was reestablishment of a friendship between Amir and Hassan, even though the latter was no longer living. On October 22, 1962, President John F.  Kennedy â€Å"informed the world† that the Soviets were building secretive missile bases in Cuba, very close to Florida. President Kennedy decided to take the peaceful route in handling is major crisis. As President, his first move was to talk to Premier Nikita Khrushchev and demand the removal of all missile bases, and â€Å"deadly content† in Cuba. Secondly, President Kennedy had â€Å"U. S. forces around the world†¦placed on alert. More than 100,000 troops deployed to Florida for a possible invasion of Cuba. Additional naval vessels were ordered to the Caribbean. B-52s loaded with nuclear weapons were in the air at all times. † (The World). He ordered a naval quarantine/blockade on Cuba to prevent Russian ships from bringing additional missile and construction materials to the island (Goldman). Because of President John Kennedy’s strong efforts to prevent this huge nuclear war, two main things came out of it. One of which is the Nuclear Test Ban Treaty. On August 5, 1963, the United States, Soviet Union, and United Kingdom signed the Limited Nuclear Test Ban Treaty. This treaty â€Å"prohibits nuclear weapons tests or other nuclear explosions under water, in the atmosphere, or in outer space, allows underground nuclear tests as long as no radioactive debris falls outside the boundaries of the nation conducting the test, and pledges signatories to work towards complete disarmament, an end to the armaments race, and an end to the contamination of the environment by radioactive substances. † (Nuclear). Also, because President John Kennedy decided to take the peaceful route to settling this dispute, he prevented a huge nuclear war from happening, maybe even another World War. Premier Nikita Khrushchev described it as, â€Å"The two most powerful nations had been squared off against each other, each with its finger on the button. † (Nuclear). If this other World War or massive nuclear war would have occurred, just think of where we would be today. â€Å"The founding of the Peace Corps is one of President John F. Kennedy’s most enduring legacies. † (Founding). As soon as President Kennedy became the President, he vowed to help Americans be â€Å"active citizens. † One of his first moves in office was to create the Peace Corps. The way he came up with this idea of the Peace Corps was when he spoke to students at the University of Michigan during a campaign speech and challenged them to live and work in other countries to dedicate â€Å"themselves to the cause of peace and development. † (Peace). The main purpose for this was so â€Å"Americans can volunteer to work anywhere in the world where assistance is needed. † (John F. Kennedy, the 35th). This answers President Kennedy’s call to â€Å"ask not what your country can do for you—ask what you can do for your country. † (Founding). President John Kennedy was very involved in the Peace Corps. He got to know all of the volunteers very well. Peace Corps volunteers became known as â€Å"Kennedy’s Kids† because if the special bond President Kennedy felt with them. Volunteers in the Peace Corps â€Å"help people of interest countries meet their needs for trained workers†, they help others understand the Americas better, and also to help people of America understand those of other countries. In the 1960s, the Peace Corps was immensely popular because of his campaign speech at the college, which encouraged newly graduated college students to join and help around the world. From that point in time, the Peace Corps continue to grow. Today, more than 195,000 volunteers have served in over â€Å"139 host countries to work on issues ranging from AIDS education to information technology and environmental preservation. † (Peace) Today’s world is a lot different compared to the world in the 1960s. The Peace Corps continually change with the times. People still volunteer as much, and even more than they did in the 1960s. Issues in other countries have severed over time, but because of the Peace Corps, people can help lessen this severe issue. The last effect of President Kennedy’s involvement is that because volunteers traveled around the world, we now know more about others’ cultures and traditions. The volunteers of the Peace Corps would live in different host countries, and adapt to their surroundings. They would learn multiple traditions and witness many cultural practices. When volunteers would return home, they would share their many experiences with family and friends, thus causing it to be spread and learned throughout the world. In the late 1950s, the Space Race was initiated when the Soviet Union launched Sputnik, the first artificial Earth satellite. From that point on, the Soviet Union and United States faced off to be the first country to land on the moon. President Kennedy feared that if the United States were not the first to land on the moon, that everyone would see them as a weak country that is â€Å"behind communist Russia† (Mills), and he did not want that image for his country. On May 25, 1961, President Kennedy submitted the lunar landing program to congress (Mills). In a meeting between President Kennedy, vice president Johnson, and Premier Khrushchev, they all decided that conquering space was a huge ordeal. Both countries wanted to show their military strength and scientific superiority. Premier Khrushchev wanted to show that communist technology was superior. According to President Kennedy, â€Å"No single space project in this period will be more impressive to mankind, or more important for the long-range exploration of space. And none will be so difficult or expensive to accomplish† (Mills). Without President Kennedy’s persistent thrive to enter space, we wouldn’t be where we are today. Before his time, space travel was just a dream. Sadly, on November 22, 1963, President Kennedy was shot and killed in Dallas, Texas for a NASA meeting of some sort. His vice president, Lyndon B. Johnson, however, carried on his â€Å"lunar landing† wish. Finally, in 1969, astronaut Neil Armstrong was the first man on the moon, thus ending the space race between Russia and the United States. Landing on the moon was the story of the century. According to a Jefferson City, MO newspaper, â€Å"the walk on the moon, although viewed via television, still seems like a chapter from Jules Verne’s fantasies. If] the moon-walk not been televised, we believe there would be many in the world who still would be doubting† (Mills). The placement of the flag on the moon was an unforgettable sight- one which will be long remembered by man, especially the grateful and proud Americans. In President Kennedy’s campaign for president, he promised â€Å"executive, moral, and legislative leadership to combat racial discrimination† (John F. Kennedy John). One of his first actions was to appoint many African Americans into office. One of which was Thurgood Marshall, a federal judge, and he directed the NAACP. Because of all of this, African Americans felt as if they actually had â€Å"friends† in the justice department. In May of 1961, the Kennedy Administration sent officials to protect Martin Luther King, Jr. from a mob during the â€Å"freedom rides† (John F. Kennedy John). His Civil Rights Address was a turning point for the country, and this also meant that President Kennedy could potentially lose the south and his 1964 election, or it would â€Å"dead lock congress† (John F. Kennedy John). Everything that President Kennedy did for this Civil Rights Movement helped change the course of discrimination in the world. He put a stop to public display of discrimination by passing the Civil Rights Act of 1964, which also attempted to deal with the problem of African Americans being denied the right to vote in the South. Also, his brave Civil rights Address, which could have cost him his election, moved an immense amount of people. It changes their minds on the topic of discrimination, and in today’s world, discrimination is very slim. In all of these events in history, President Kennedy changed the world for a better. From preventing a huge nuclear war from happening, to stopping discrimination; President Kennedy is the definition of a great president.
